Best Practices Addressing Elements within the Public ROW during ConstructionStatus: ActiveProject Start Date: 08/16/2024Subscribe for Updates Summary: During roadway construction, one issue that arises is ensuring private elements/assets (i.e., irrigation systems, landscaping, pavers, signs, electrical conduit, etc.) near the roadway and within the public right of way (ROW) are accounted for and properly maintained post project. Most publicly owned elements and utilities are recorded on public record and can be identified before a project begins. The same cannot be said for private elements. These are often not on public record and therefore sometimes generate issues during construction. Many cities do not allow private irrigation systems within public ROW. There is a question about who is liable for the replacement of these between the owning agency, the private landowner, and the contractor. Communication between these parties is critical to a positive resolution to these conflicts. This project will attempt to address these concerns by identifying best practices related to the maintenance of private elements in the public ROW.
