Barriers to Right-of-Way Acquisition and Recommendations for ChangeStatus: CompleteReport Date: 08/26/2016 Summary: The cost of acquiring property for transportation project rights of way (ROWs) has increased significantly in recent years for local agencies in Minnesota. This research used a literature search, statewide survey and interviews, and case studies to identify barriers that increase ROW acquisition costs and delays, and to make recommendations to improve the process. Many of the recommendations require legislative changes to address issues such as attorney's fees and appraisal-timing requirements. Other strategies, such as involving ROW staff early on to build trust with property owners, can be directly implemented by local agencies.
